حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا هُشَيْمٌ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم
" الْعُمْرَى جَائِزَةٌ لأَهْلِهَا وَالرُّقْبَى جَائِزَةٌ لأَهْلِهَا " . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ . وَقَدْ رَوَاهُ بَعْضُهُمْ عَنْ أَبِي الزُّبَيْرِ بِهَذَا الإِسْنَادِ عَنْ جَابِرٍ مَوْقُوفًا وَلَمْ يَرْفَعْهُ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ أَنَّ الرُّقْبَى جَائِزَةٌ مِثْلَ الْعُمْرَى . وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ . وَفَرَّقَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَهْلِ الْكُوفَةِ وَغَيْرِهِمْ بَيْنَ الْعُمْرَى وَالرُّقْبَى فَأَجَازُوا الْعُمْرَى وَلَمْ يُجِيزُوا الرُّقْبَى . قَالَ أَبُو عِيسَى وَتَفْسِيرُ الرُّقْبَى أَنْ يَقُولَ هَذَا الشَّىْءُ لَكَ مَا عِشْتَ فَإِنْ مِتَّ قَبْلِي فَهِيَ رَاجِعَةٌ إِلَىَّ . وَقَالَ أَحْمَدُ وَإِسْحَاقُ الرُّقْبَى مِثْلُ الْعُمْرَى وَهِيَ لِمَنْ أُعْطِيَهَا وَلاَ تَرْجِعُ إِلَى الأَوَّلِ .
Ahmad bin Mani` told us, Hushaym told us, on the authority of Dawud bin Abi Hind, on the authority of Abu al-Zubayr, on the authority of Jabir, he said: The Messenger of God, may God bless him and grant him peace, said. Al-Umri is permissible for its people, and Al-Raqi is permissible for its people.” Abu Issa said, “This is a hasan hadith.” Some of them narrated it on the authority of My father Al-Zubayr has this chain of narration on the authority of Jabir, and he did not narrate it. This is acted upon according to some people of knowledge among the companions of the Prophet, may God bless him and grant him peace. And others say that the ruqabi is permissible, like the umra. This is the view of Ahmad and Ishaq. Some of the scholars differed from among the people of Kufa and others, between Al-Umri and Al-Ruqi, so they allowed Al-Umri but did not allow Al-Ruqi. Abu Issa said, and the interpretation of Al-Ruqi is that he says this. The thing is yours as long as you live, and if you die before me, it will return to me. Ahmad and Ishaq Al-Ruqi said, it is like an old woman, and it will belong to the one to whom I give it. And do not go back to the beginning...
