حَدَّثَنَا أَبُو سَعِيدٍ الأَشَجُّ، حَدَّثَنَا أَبُو خَالِدٍ الأَحْمَرُ، حَدَّثَنَا الأَعْمَشُ، عَنْ أَبِي صَالِحٍ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم
" إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا ثَلاَثًا بِكِتَابِ اللَّهِ فَإِنْ عَادَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ " . قَالَ وَفِي الْبَابِ عَنْ عَلِيٍّ وَأَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ وَشِبْلٍ عَنْ عَبْدِ اللَّهِ بْنِ مَالِكٍ الأَوْسِيِّ . قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رُوِيَ عَنْهُ مِنْ غَيْرِ وَجْهٍ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ رَأَوْا أَنْ يُقِيمَ الرَّجُلُ الْحَدَّ عَلَى مَمْلُوكِهِ دُونَ السُّلْطَانِ وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ . وَقَالَ بَعْضُهُمْ يُرْفَعُ إِلَى السُّلْطَانِ وَلاَ يُقِيمُ الْحَدَّ هُوَ بِنَفْسِهِ . وَالْقَوْلُ الأَوَّلُ أَصَحُّ .
Abu Saeed Al-Ashj told us, Abu Khaled Al-Ahmar told us, Al-Amash told us, on the authority of Abu Salih, on the authority of Abu Hurairah, he said, the Messenger of God, may God bless him and grant him peace, said He said: “If the female slave of any of you commits adultery, let him flog her three times according to the Book of God, but if she does so again, let him sell her, even if it is for a strand of hair.” He said, and on the authority of Ali, Abu Hurairah, Zayd bin Khalid, and Shibl, on the authority of Abdullah bin Malik Al-Awsi. Abu Issa said the hadith of my father Hurairah is a hasan and authentic hadith, and it was narrated from him through more than one authority. This is acted upon according to some of the people of knowledge among the companions of the Prophet, may God bless him and grant him peace. He and others were of the opinion that a man should impose a punishment on his property, not the authority, and this is the view of Ahmad and Ishaq. Some of them said that it should be raised to The authority does not impose the punishment by himself. The first saying is more correct.
