Jami' at-Tirmidhi — Hadith #29139

Abd bin Humaid told us, Hisham bin Al-Qasim told us, on the authority of Al-Mubarak bin Fadalah, on the authority of Al-Hasan, on the authority of Maqil bin Yasar, that he married His sister was a Muslim man during the time of the Messenger of God, may God bless him and grant him peace, and she was with him as long as she was, then he divorced her completely and did not take her back until The waiting period had passed, so he married her and his identity, then he proposed to her with the fiancé, and he said to him, “What a fool, I honored you with her and married you to her,” so I divorced her. By God, she will never return to you. This is the last thing you owe. He said, “So God knew his need for her and her need for her husband, so God revealed (And when you divorce women, and they fulfilled their appointed time) to His saying: (And you do not know.) So when Maqil heard it, he said, “I hear my Lord and in obedience.” Then he called him. He said, “I will marry you and honor you.” Abu Issa said, “This is a good and authentic hadith. It was narrated in more than one direction, on the authority of Al-Hasan. And in this Hadith An indication that it is not permissible to marry without a guardian, because the sister of Maqil ibn Yasar was a married woman, so if the matter had been up to her without her guardian, she would have gotten married. itself and did not need its guardian Maqil ibn Yasar. Rather, God in the verse addressed the saints and said: (And do not neglect them. To marry their wives.) This verse indicates that the command is up to the guardians to marry with their consent.
