حَدَّثَنَا هَارُونُ بْنُ إِسْحَاقَ الْهَمْدَانِيُّ، حَدَّثَنَا عَبْدَةُ بْنُ سُلَيْمَانَ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ نَاجِيَةَ الْخُزَاعِيِّ، صَاحِبِ بُدْنِ رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ قُلْتُ يَا رَسُولَ اللَّهِ كَيْفَ أَصْنَعُ بِمَا عَطِبَ مِنَ الْبُدْنِ قَالَ
" انْحَرْهَا ثُمَّ اغْمِسْ نَعْلَهَا فِي دَمِهَا ثُمَّ خَلِّ بَيْنَ النَّاسِ وَبَيْنَهَا فَيَأْكُلُوهَا " . وَفِي الْبَابِ عَنْ ذُؤَيْبٍ أَبِي قَبِيصَةَ الْخُزَاعِيِّ . قَالَ أَبُو عِيسَى حَدِيثُ نَاجِيَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ قَالُوا فِي هَدْىِ التَّطَوُّعِ إِذَا عَطِبَ لاَ يَأْكُلُ هُوَ وَلاَ أَحَدٌ مِنْ أَهْلِ رُفْقَتِهِ وَيُخَلَّى بَيْنَهُ وَبَيْنَ النَّاسِ يَأْكُلُونَهُ وَقَدْ أَجْزَأَ عَنْهُ . وَهُوَ قَوْلُ الشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ . وَقَالُوا إِنْ أَكَلَ مِنْهُ شَيْئًا غَرِمَ بِقَدْرِ مَا أَكَلَ مِنْهُ . وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ إِذَا أَكَلَ مِنْ هَدْىِ التَّطَوُّعِ شَيْئًا فَقَدْ ضَمِنَ الَّذِي أَكَلَ .
Harun bin Ishaq Al-Hamdani told us, Abdah bin Sulayman told us, on the authority of Hisham bin Urwa, on the authority of his father, on the authority of Najiya Al-Khuza’i, The owner of the body of the Messenger of God, may God bless him and grant him peace, said: I said, O Messenger of God, what should I do with what is damaged from the body? He said: “Slaughter it, then dip its soles.” In its blood, then mix it between the people and let them eat it.” And on the authority of Dhu’ayb Abi Qubaisah Al-Khuza’i. Abu Issa said a hadith Najiya, a hasan and authentic hadith. And this is to be acted upon according to the people of knowledge. They said regarding the guidance of tawtu’, if it is spoiled neither he nor anyone else will eat it. From The family of his companions, and he should be kept separate from himself while the people eat him, and that is sufficient. This is the opinion of Al-Shafi’i, Ahmad, and Ishaq. And they said: If he eats any of it, he will be fined in proportion to what he ate of it. Some of the people of knowledge said that if he eats any of the voluntary sacrifice, then the one who ate is liable. .
