حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " الْعَجْمَاءُ جُرْحُهَا جُبَارٌ وَالْبِئْرُ جُبَارٌ وَالْمَعْدِنُ جُبَارٌ وَفِي الرِّكَازِ الْخُمُسُ " .
حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، وَأَبِي، سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم نَحْوَهُ . قَالَ وَفِي الْبَابِ عَنْ جَابِرٍ وَعَمْرِو بْنِ عَوْفٍ الْمُزَنِيِّ وَعُبَادَةَ بْنِ الصَّامِتِ . قَالَ أَبُو عِيسَى حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ . حَدَّثَنَا الأَنْصَارِيُّ حَدَّثَنَا مَعْنٌ قَالَ أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ وَتَفْسِيرُ حَدِيثِ النَّبِيِّ صلى الله عليه وسلم " الْعَجْمَاءُ جُرْحُهَا جُبَارٌ " . يَقُولُ هَدَرٌ لاَ دِيَةَ فِيهِ . قَالَ أَبُو عِيسَى وَمَعْنَى قَوْلِهِ " الْعَجْمَاءُ جُرْحُهَا جُبَارٌ " . فَسَّرَ ذَلِكَ بَعْضُ أَهْلِ الْعِلْمِ قَالُوا الْعَجْمَاءُ الدَّابَّةُ الْمُنْفَلِتَةُ مِنْ صَاحِبِهَا فَمَا أَصَابَتْ فِي انْفِلاَتِهَا فَلاَ غُرْمَ عَلَى صَاحِبِهَا . " وَالْمَعْدِنُ جُبَارٌ " . يَقُولُ إِذَا احْتَفَرَ الرَّجُلُ مَعْدِنًا فَوَقَعَ فِيهَا إِنْسَانٌ فَلاَ غُرْمَ عَلَيْهِ وَكَذَلِكَ الْبِئْرُ إِذَا احْتَفَرَهَا الرَّجُلُ لِلسَّبِيلِ فَوَقَعَ فِيهَا إِنْسَانٌ فَلاَ غُرْمَ عَلَى صَاحِبِهَا . " وَفِي الرِّكَازِ الْخُمُسُ " . وَالرِّكَازُ مَا وُجِدَ فِي دَفْنِ أَهْلِ الْجَاهِلِيَّةِ . فَمَنْ وَجَدَ رِكَازًا أَدَّى مِنْهُ الْخُمُسَ إِلَى السُّلْطَانِ وَمَا بَقِيَ فَهُوَ لَهُ .
Ahmad bin Mani’ told us, Sufyan told us, on the authority of Al-Zuhri, on the authority of Sa’id bin Al-Musayyab, on the authority of Abu Hurairah, he said, “The Messenger of God, may God bless him and grant him peace, said.” “The blind woman’s wound is mighty, and the well is mighty, and the mine is mighty, and there are five ores in the ore.” Qutaibah told us, he told us Al-Layth, on the authority of Ibn Shihab, on the authority of Sa’id ibn al-Musayyab, and Abu Salama ibn Abd al-Rahman, on the authority of Abu Hurairah, on the authority of the Prophet, may God bless him and grant him peace, and the like. He said, on the authority of Jabir, Amr ibn Awf al-Muzani, and Ubadah ibn al-Samit. Abu Issa said the hadith of Abu Hurairah is a hasan hadith. Sahih. Al-Ansari told us, Maan told us, he said, Malik bin Anas told us, and the interpretation of the hadith of the Prophet, may God bless him and grant him peace, “A blind woman is wounded by a tyrant.” He says, “It is a waste that does not entail blood money.” Abu Issa said, “The blind woman was wounded by a tyrant.” Some of the people of Knowledge: They said, “A barren animal that has escaped from its owner, and if it harms it in its escape, then there is no blame on its owner.” And the Metal is mighty. He says, “If a man digs a mineral and a person falls into it, he will not be held liable. The same applies to the well if the man digs it.” For the sake of it, and a person falls into it, and there is no blame on its owner. “And in the five piles.” And the pile is what was found in the burial of the people of Pre-Islamic times. Whoever finds a treasure and gives a fifth of it to the ruler, and whatever remains is his.
