حَدَّثَنَا أَبُو كُرَيْبٍ، حَدَّثَنَا أَبُو بَكْرِ بْنُ عَيَّاشٍ، عَنْ عَاصِمِ بْنِ بَهْدَلَةَ، عَنْ أَبِي صَالِحٍ، عَنْ مُعَاوِيَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ فِي الرَّابِعَةِ فَاقْتُلُوهُ ‏"‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ أَبِي هُرَيْرَةَ وَالشَّرِيدِ وَشُرَحْبِيلَ بْنِ أَوْسٍ وَجَرِيرٍ وَأَبِي الرَّمَدِ الْبَلَوِيِّ وَعَبْدِ اللَّهِ بْنِ عَمْرٍو ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ مُعَاوِيَةَ هَكَذَا رَوَى الثَّوْرِيُّ أَيْضًا عَنْ عَاصِمٍ عَنْ أَبِي صَالِحٍ عَنْ مُعَاوِيَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏ وَرَوَى ابْنُ جُرَيْجٍ وَمَعْمَرٌ عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏ قَالَ سَمِعْتُ مُحَمَّدًا يَقُولُ حَدِيثُ أَبِي صَالِحٍ عَنْ مُعَاوِيَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم فِي هَذَا أَصَحُّ مِنْ حَدِيثِ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏ وَإِنَّمَا كَانَ هَذَا فِي أَوَّلِ الأَمْرِ ثُمَّ نُسِخَ بَعْدُ هَكَذَا رَوَى مُحَمَّدُ بْنُ إِسْحَاقَ عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏"‏ إِنَّ مَنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ فَإِنْ عَادَ فِي الرَّابِعَةِ فَاقْتُلُوهُ ‏"‏ ‏.‏ قَالَ ثُمَّ أُتِيَ النَّبِيُّ صلى الله عليه وسلم بَعْدَ ذَلِكَ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فِي الرَّابِعَةِ فَضَرَبَهُ وَلَمْ يَقْتُلْهُ ‏.‏ وَكَذَلِكَ رَوَى الزُّهْرِيُّ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ عَنِ النَّبِيِّ صلى الله عليه وسلم نَحْوَ هَذَا ‏.‏ قَالَ فَرُفِعَ الْقَتْلُ وَكَانَتْ رُخْصَةً ‏.‏ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ عَامَّةِ أَهْلِ الْعِلْمِ لاَ نَعْلَمُ بَيْنَهُمُ اخْتِلاَفًا فِي ذَلِكَ فِي الْقَدِيمِ وَالْحَدِيثِ وَمِمَّا يُقَوِّي هَذَا مَا رُوِيَ عَنِ النَّبِيِّ صلى الله عليه وسلم مِنْ أَوْجُهٍ كَثِيرَةٍ أَنَّهُ قَالَ ‏"‏ لاَ يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ يَشْهَدُ أَنْ لاَ إِلَهَ إِلاَّ اللَّهُ وَأَنِّي رَسُولُ اللَّهِ إِلاَّ بِإِحْدَى ثَلاَثٍ النَّفْسُ بِالنَّفْسِ وَالثَّيِّبُ الزَّانِي وَالتَّارِكُ لِدِينِهِ ‏"‏ ‏.‏
Abu Kurayb told us, Abu Bakr bin Ayyash told us, on the authority of Asim bin Bahdala, on the authority of Abu Salih, on the authority of Muawiyah, the Messenger of God, may God bless him and grant him peace, said He, peace and blessings of God be upon him, said: “Whoever drinks alcohol, flog him, and if he returns on the fourth day of prayer, kill him.” He said, and on the authority of Abu Hurairah and Al-Shareed. And Sharhabeel bin Aws, Jarir, Abu Al-Ramad Al-Balawi, and Abdullah bin Amr. Abu Issa said the hadith of Muawiyah: This is how Al-Thawri narrated it. Also, on the authority of Asim, on the authority of Abu Salih, on the authority of Muawiyah, on the authority of the Prophet, may God bless him and grant him peace. And Ibn Jurayj and Ma’mar narrated on the authority of Suhail bin Abi Salih, on the authority of His father, on the authority of Abu Hurairah, on the authority of the Prophet, may God’s prayers and peace be upon him. He said: I heard Muhammad saying that the hadith of Abu Salih on the authority of Muawiyah on the authority of the Prophet, may God’s prayers and peace be upon him, is more authentic than this. The hadith of Abu Salih on the authority of Abu Hurairah on the authority of the Prophet, may God bless him and grant him peace. But this was only at the beginning of the matter and then it was abrogated. After this, Muhammad bin Ishaq narrated on the authority of Muhammad bin Al-Munkadir, on the authority of Jabir bin Abdullah, on the authority of the Prophet, may God’s prayers and peace be upon him, who said: “Indeed, whoever drinks “If he drinks alcohol, flog him, and if he returns at the fourth hour, kill him.” He said, “Then a man who had drunk was brought to the Prophet, may God bless him and grant him peace.” He drank alcohol on the fourth day, so he struck him but did not kill him. Likewise, Al-Zuhri narrated something like this on the authority of Qubaysah ibn Dhu’ayb, on the authority of the Prophet, may God bless him and grant him peace. He said, “Then the killing was lifted, and it was a license.” This hadith is acted upon by the majority of scholars, and we do not know of any disagreement among them regarding this matter. In ancient and modern times, and what strengthens this is what was narrated on the authority of the Prophet, may God bless him and grant him peace, in many ways, that he said, “It is not permissible to shed the blood of a Muslim man.” He bears witness that there is no god but God and that I am the Messenger of God, except by one of three things: a soul for a soul, the married man, the adulterer, and the one who abandons his religion. “.
