حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا ابْنُ لَهِيعَةَ، عَنْ عَيَّاشِ بْنِ عَبَّاسٍ الْمِصْرِيِّ، عَنْ شُيَيْمِ بْنِ بَيْتَانَ، عَنْ جُنَادَةَ بْنِ أَبِي أُمَيَّةَ، عَنْ بُسْرِ بْنِ أَرْطَاةَ، قَالَ سَمِعْتُ النَّبِيَّ صلى الله عليه وسلم يَقُولُ
" لاَ تُقْطَعُ الأَيْدِي فِي الْغَزْوِ " . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ غَرِيبٌ . وَقَدْ رَوَى غَيْرُ ابْنِ لَهِيعَةَ بِهَذَا الإِسْنَادِ نَحْوَ هَذَا . وَيُقَالُ بُسْرُ بْنُ أَبِي أَرْطَاةَ أَيْضًا . وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْهُمُ الأَوْزَاعِيُّ لاَ يَرَوْنَ أَنْ يُقَامَ الْحَدُّ فِي الْغَزْوِ بِحَضْرَةِ الْعَدُوِّ مَخَافَةَ أَنْ يَلْحَقَ مَنْ يُقَامُ عَلَيْهِ الْحَدُّ بِالْعَدُوِّ فَإِذَا خَرَجَ الإِمَامُ مِنْ أَرْضِ الْحَرْبِ وَرَجَعَ إِلَى دَارِ الإِسْلاَمِ أَقَامَ الْحَدَّ عَلَى مَنْ أَصَابَهُ . كَذَلِكَ قَالَ الأَوْزَاعِيُّ .
Qutaibah told us, Ibn Lahi’ah told us, on the authority of Ayyash ibn Abbas al-Masri, on the authority of Shayyam ibn Bitan, on the authority of Junada ibn Abi Umayyah, on the authority of Busr bin Artat said: I heard the Prophet, may God’s prayers and peace be upon him, saying, “Hands should not be cut off in battle.” Abu Issa said: This is a strange hadith. Someone other than Ibn Lahi’ah narrated something similar to this with this chain of transmission. It is also said that Busr bin Abi Artat was also mentioned. This is acted upon by some. The people of knowledge, including Al-Awza’i, do not think that the punishment should be carried out during an invasion in the presence of the enemy, for fear that the one against whom the punishment is being meted will be punished. With the enemy, so when the Imam leaves the land of war and returns to the abode of Islam, he imposes the punishment on whoever harms him. This is what Al-Awza’i said.
