حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا مَرْوَانُ بْنُ مُعَاوِيَةَ الْفَزَارِيُّ، عَنْ يَزِيدَ بْنِ زِيَادٍ الدِّمَشْقِيِّ، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، قَالَتْ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " لاَ تَجُوزُ شَهَادَةُ خَائِنٍ وَلاَ خَائِنَةٍ وَلاَ مَجْلُودٍ حَدًّا وَلاَ مَجْلُودَةٍ وَلاَ ذِي غِمْرٍ لأَخِيهِ وَلاَ مُجَرَّبِ شَهَادَةٍ وَلاَ الْقَانِعِ أَهْلَ الْبَيْتِ لَهُمْ وَلاَ ظَنِينٍ فِي وَلاَءٍ وَلاَ قَرَابَةٍ " . قَالَ الْفَزَارِيُّ الْقَانِعُ التَّابِعُ . هَذَا حَدِيثٌ غَرِيبٌ لاَ نَعْرِفُهُ إِلاَّ مِنْ حَدِيثِ يَزِيدَ بْنِ زِيَادٍ الدِّمَشْقِيِّ . وَيَزِيدُ يُضَعَّفُ فِي الْحَدِيثِ وَلاَ يُعْرَفُ هَذَا الْحَدِيِثُ مِنْ حَدِيثِ الزُّهْرِيِّ إِلاَّ مِنْ حَدِيثِهِ . وَفِي الْبَابِ عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو . قَالَ وَلاَ نَعْرِفُ مَعْنَى هَذَا الْحَدِيثِ وَلاَ يَصِحُّ عِنْدِي مِنْ قِبَلِ إِسْنَادِهِ . وَالْعَمَلُ عِنْدَ أَهْلِ الْعِلْمِ فِي هَذَا أَنَّ شَهَادَةَ الْقَرِيبِ جَائِزَةٌ لِقَرَابَتِهِ . وَاخْتَلَفَ أَهْلُ الْعِلْمِ فِي شَهَادَةِ الْوَالِدِ لِلْوَلَدِ وَالْوَلَدِ لِوَالِدِهِ وَلَمْ يُجِزْ أَكْثَرُ أَهْلِ الْعِلْمِ شَهَادَةَ الْوَالِدِ لِلْوَلَدِ وَلاَ الْوَلَدِ لِلْوَالِدِ . وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ إِذَا كَانَ عَدْلاً فَشَهَادَةُ الْوَالِدِ لِلْوَلَدِ جَائِزَةٌ وَكَذَلِكَ شَهَادَةُ الْوَلَدِ لِلْوَالِدِ . وَلَمْ يَخْتَلِفُوا فِي شَهَادَةِ الأَخِ لأَخِيهِ أَنَّهَا جَائِزَةٌ وَكَذَلِكَ شَهَادَةُ كُلِّ قَرِيبٍ لِقَرِيبِهِ . وَقَالَ الشَّافِعِيُّ لاَ تَجُوزُ شَهَادَةٌ لِرَجُلٍ عَلَى الآخَرِ وَإِنْ كَانَ عَدْلاً إِذَا كَانَتْ بَيْنَهُمَا عَدَاوَةٌ . وَذَهَبَ إِلَى حَدِيثِ عَبْدِ الرَّحْمَنِ الأَعْرَجِ عَنِ النَّبِيِّ صلى الله عليه وسلم مُرْسَلاً " لاَ تَجُوزُ شَهَادَةُ صَاحِبِ إِحْنَةٍ " . يَعْنِي صَاحِبَ عَدَاوَةٍ وَكَذَلِكَ مَعْنَى هَذَا الْحَدِيثِ حَيْثُ قَالَ " لاَ تَجُوزُ شَهَادَةُ صَاحِبِ غِمْرٍ لأَخِيهِ " يَعْنِي صَاحِبَ عَدَاوَةٍ .
Qutaibah narrated to us, Marwan bin Muawiyah Al-Fazari narrated to us, on the authority of Yazid bin Ziyad Al-Dimashqi, on the authority of Al-Zuhri, on the authority of Urwa, on the authority of Aisha, She said: The Messenger of God, may God bless him and grant him peace, said: “It is not permissible for a male or female traitor to bear testimony to his brother.” And there is no one who has tested testimony, nor is he satisfied with the people of the household, nor is there any suspicion of loyalty or kinship.” Al-Fazari, the contented follower, said this. A strange hadith that we do not know except from the hadith of Yazid ibn Ziyad al-Dimashqi. And Yazid is weakened in the hadith, but this hadith is not known from The hadith of Al-Zuhri, except for his hadith. And on the authority of Abdullah bin Amr. He said, “We do not know the meaning of this hadith, and it is not authentic in my opinion.” By its chain of transmission. The work according to the people of knowledge in this matter is that the testimony of a relative is permissible due to his kinship. The people of knowledge differed in The father’s testimony is for the child, and the child is for his father. Most scholars did not permit the father’s testimony for the child, nor the child for the father. Some scholars said that if it is just, then the father’s testimony for the child is permissible, and so is the child’s testimony for the father. And they did not. They disagree about The testimony of a brother to his brother is permissible, as is the testimony of every relative to his relative. Al-Shafi’i said: It is not permissible for one man to bear witness against another, even if He was just if there was enmity between them. He went to the hadith of Abd al-Rahman al-Araj on the authority of the Prophet, may God bless him and grant him peace, as a messenger, “No.” It is permissible to bear the testimony of one who is benevolent. “This means one who is benevolent,” and likewise the meaning of this hadith, where it said, “It is not permissible to bear the testimony of one who is benevolent.” “An enmity toward his brother” means a man of enmity.
